Withdrawal

1. RIGHT OF WITHDRAWAL

1.1 Users who are consumers have the right to withdraw from the contract concluded with Villa Della Torre Wine Shop without incurring costs other than those indicated in this article and without having to specify a reason, within fourteen (14) calendar days starting from the date of receipt of the products (Withdrawal Period). Specifically, the Withdrawal Period expires after 14 days:

• in the case of an order relating to a single Product, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the Product;
• in the case of a Multiple Order with separate deliveries, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last Product;
• in the case of an order relating to the delivery of a Product consisting of multiple lots or pieces, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last lot or piece.

1.2. To exercise the right of withdrawal, the user must inform Villa Della Torre Wine Shop, by email, of their decision to withdraw, before the expiry of the Withdrawal Period.

1.3 To exercise the right of withdrawal, the user must send an email to wineshop@villadellatorre.it with an explicit statement of their decision to withdraw from the contract, indicating the products for which the buyer intends to exercise the right of withdrawal and specifying the order number and invoice number, if issued (Withdrawal Declaration). Since the burden of proof relating to the exercise of the right of withdrawal before the expiry of the Withdrawal Period lies with the user, it is in the user's interest to keep a copy of the email sent to Villa Della Torre Wine Shop with the Withdrawal Declaration.

1.4 In case of exercising the right of withdrawal, the user must arrange, at their own care and expense, for the return of the purchased Product(s), intact and complete in every part, within 14 days from the date of communication of the withdrawal. The Product, appropriately protected and packaged, must be shipped to the following address:

    Villa Della Torre, via della torre 25, 37022 Fumane (VR) Italy.

The buyer is responsible for the packaging of the goods they intend to return and therefore undertakes to take the necessary precautions to safeguard the integrity of the product or products to preserve them from any damage and/or alteration.

 

The direct costs of returning the Product to Villa Della Torre Wine Shop are borne by the user. The return of the Product to Villa Della Torre Wine Shop is under the responsibility of the user.

Should the user have used a discount code for the purchase of the Product for which they exercised the right of withdrawal, the refund will only be made with reference to the sum of money actually spent by the user, and not with regard to the value of the discount code.

Without prejudice to the right to verify the user's compliance with the above, Villa Della Torre Wine Shop will credit the withdrawn user with the amount paid for the purchase of the product(s) for which the withdrawal was exercised, within a maximum period of fourteen days from the date on which the seller received the returned goods from the withdrawn user. Within the same period, Villa Della Torre Wine Shop undertakes to inform the withdrawn user of any damage found on the returned goods.

Therefore, the crediting of the amount paid will not take place before: a) Villa Della Torre Wine Shop has received the shipment of the product(s) at the expense and care of the withdrawn user; b) Villa Della Torre Wine Shop has verified the integrity of the product(s).

 The Product must in any case be stored, handled and inspected with normal diligence and returned intact, complete in all its parts, accompanied by all existing accessories, still attached to the Product and intact and not tampered with, as well as free from signs of wear or dirt. Furthermore, the withdrawal applies to the Product in its entirety. It cannot therefore be exercised in relation to parts and/or accessories (which do not constitute autonomous Products) of the Product.

Withdrawal exercised in a manner not compliant with what is indicated in this section will not be considered regular and legitimate and the request will be rejected by Villa Della Torre Wine Shop, which will therefore not issue any refund. If, in the event of irregular or illegitimate withdrawal by the user, the products have already been returned to Villa Della Torre Wine Shop, they will remain at the user's disposal for collection, at their own care and expense, for a maximum period of 60 days, after which they will be disposed of and no longer available to the user.

Non-intact products cannot be returned.

In the event that, under one of the legal hypotheses, the right of withdrawal does not apply, specific and express communication of this exclusion will be provided, in any case, during the purchase process, before the user proceeds with the transmission of the order. The user is reminded in any case that, pursuant to art. 59 of the Consumer Code, the right of withdrawal is excluded, among other things, in cases where the sale concerns:

(i) custom-made or clearly personalized products;
(ii) sealed products that are not suitable for return for hygienic reasons or related to health protection, which have been opened after delivery.
